Terms of service
Welcome to Casonda. These Terms of Service ("Terms") govern your access to and use of www.casonda.com (the "Site") and any purchase you make through it. The Site is operated by DriveDream Limited ("Casonda", "we", "us", or "our"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site or place an order.
1. Order Process
The items you purchase are sold directly by DriveDream Limited (Casonda) to you. You will provide your payment information, shipping address, and any additional required information directly to us for processing your payment and completing your order. An order is an offer to buy; a contract of sale is formed only when we accept your order and dispatch the goods. Our order-confirmation email acknowledges receipt but does not by itself constitute acceptance.
2. Conditions of Use
Your order and your use of the Site are subject to these Terms of Service, our Privacy Policy, and any relevant terms and conditions imposed by applicable third parties, including any party supplying the products. By completing your purchase, you confirm that you have read and agree to be bound by all of these Terms.
3. Eligibility
You must be able to form a legally binding contract to use the Site. If you are under the age of majority in your jurisdiction, the approval of a parent or guardian is required to complete your purchase.
4. Account Terms
You may create an account to check out faster and manage your orders. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. You agree to provide accurate, current, and complete information and to keep it up to date. We may suspend or terminate an account that we reasonably believe has been used in breach of these Terms or for fraudulent activity.
5. Products, Descriptions, Pricing and Availability
We take care to describe and display our products accurately; however, we do not warrant that product descriptions, colours, images, or other content are error-free, and actual colours may vary slightly due to photography, screens, and light source. Prices on the Site are displayed in US Dollars (USD) unless otherwise stated at checkout, and may change at any time before an order is placed. If there is an error in the price listed for a product or applied during processing, we are entitled to contact you, correct the price, and/or cancel your order. All products are subject to availability, and we may limit quantities or discontinue any product at any time.
6. Payment and Verification
You are purchasing from, and providing your information to, DriveDream Limited (Casonda). We are entitled to verify and authenticate your payment information, and if we are unable to verify it, we may contact you and/or your payment card issuer to confirm your identity and/or your intent to place the order. Once we successfully verify your payment information, the transaction will be processed by us as the seller of the goods. We may refuse service, refuse to process or complete orders, or cancel orders at our reasonable discretion.
7. Shipping and Fulfilment
Shipping and delivery are governed by our Shipping Policy, which forms part of these Terms. Where an order contains multiple items, it may be fulfilled in one or more shipments; you will only be charged for the items actually fulfilled.
8. Returns, Refunds and Warranty
Returns, exchanges, and refunds are handled in accordance with our Refund & Return Policy, which forms part of these Terms. Our products are covered by a 12-month warranty against manufacturing defects from the date of delivery. This warranty does not cover damage caused by misuse, improper installation, accidents, normal wear, or unauthorised modification.
9. Acceptable Use
You agree not to use the Site or its content to breach any applicable law or regulation; to infringe our or any third party's intellectual property or other rights; to transmit malware, attempt to gain unauthorised access to the Site, or interfere with its normal operation; to collect or harvest data about other users; or to place fraudulent orders or use the Site for any unlawful or abusive purpose.
10. Chargebacks, Fraud Prevention and Void Transactions
For your protection, we may use industry-standard fraud-prevention and verification systems, including card authentication and "ship-to" / "bill-to" address verification. If a transaction's authorisation is declined but processed due to a systemic error, that transaction will be void. 11. Intellectual Property
All content on the Site is owned by DriveDream Limited (Casonda) or its licensors and is protected by applicable copyright and trademark laws. Please see our separate Intellectual Property Rights page for full details. Such content may not be used without our prior written authorisation.
12. Third-Party Links and Services
The Site may contain links to third-party websites or services that we do not control. We are not responsible for the content, policies, or practices of any third party, and access to them is at your own risk.
13. Disclaimer of Warranties
Except as expressly provided in these Terms or the product warranty, the Site and products are provided "as is" and "as available". We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Your use of the products is at your own risk.
14. Limitation of Liability
To the maximum extent permitted by law, DriveDream Limited (Casonda) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or your purchase. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.
15. Indemnification
You agree to indemnify and hold harmless DriveDream Limited (Casonda) and its officers, directors, and employees from any claims, losses, or expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Site.
16. Currency and Billing
Prices and charges are displayed in USD unless otherwise indicated at checkout. If your bank or card provider settles in a different currency, the final amount charged may differ due to exchange rates or fees applied by your financial institution. We do not control such exchange rates or fees.
17. Electronic Communications
When you place an order you communicate with us electronically, and you consent to receiving communications from us electronically (for example, by email), and agree that such communications satisfy any legal requirement that they be in writing.
18. Force Majeure
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, public-health events, strikes, carrier or supplier failures, customs delays, or interruptions to power or communications.
19. Modifications to These Terms
We may update our system, policies, and these Terms at any time. The current version applies to each order at the time it is placed. Any order placed after a change takes effect constitutes acceptance of the updated Terms.
20. Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
21. Severability
If any part of these Terms is found invalid or unenforceable, that part will be severed and will not affect the validity of the remaining Terms.
22. Entire Agreement
These Terms, together with our Privacy Policy, Shipping Policy, Refund & Return Policy, and Intellectual Property Rights page, constitute the entire agreement between you and us regarding your use of the Site and supersede any prior agreements.
23. Governing Law
These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-law provisions.
24. Dispute Resolution and Proceedings
Any dispute arising out of or relating to these Terms shall be subject to the courts of the Hong Kong Special Administrative Region, and you irrevocably agree to the jurisdiction of those courts for such purposes.

This agreement and all related documents are drawn up in English.
